A Federal High Court sitting in Port Harcourt has ruled that it is unconstitutional and illegal for the Rivers State Government to restrict human and vehicular movement under the guise of monthly environmental sanitation.
Justice Omotosho of the Federal High Court, gave the ruling on Monday, in a suit filed by one Barr Azubuike Prince challenging the power of the State Government to restrict human and vehicular movements during environmental sanitation.
The Judge, said any law authorizing the State Government to restrict movement of people in the state is unconstitutional for being inconsistent with the provisions of the constitution.
He awarded the sum of N1,000,000.00 in favour of the applicant against the Respondents with 10% interest rate per annum until the judgment sum is liquidated.
He also ruled that the barricading of Ada George Road on the 31st day of October, 2020 by men of Ada George Police Station under the instruction of the Rivers State Waste Management Agency is illegal, unconstitutional, null and void.
