The legal team of former member of the Federal House of Representatives Dr. Farah Dagogo has formally protested the recent transfer of his case challenging the suspension of elected officials in Rivers State to Abuja, calling it a breach of judicial independence and due process.
In a letter addressed to the Chief Judge of the Federal High Court and copied to the Presiding Judge in Port Harcourt, lead counsel Cosmas Enweluzo, SAN, condemned the transfer, warning it could undermine public confidence in the judiciary.
“Allowing a party to dictate the forum of adjudication sets a dangerous precedent,” the letter stated.
Enweluzo argued that the Attorney-General, who is involved in the case through his representation of the President, lacks the legal authority to request or influence the movement of the case to another judicial division. The letter also noted that no formal application for the transfer had been filed, nor were any valid legal grounds—such as manifest injustice—presented to justify the decision.
