The Court of Appeal, Port Harcourt Division, has upheld the judgment of the Rivers State High Court that nullified the congresses which produced the Tony Okocha-led executive of the All Progressives Congress (APC) in Rivers State.
The appellate court, in a judgment delivered on Friday by Justice Elfreida Oluwayemisi Williams-Dawodu, affirmed the earlier decision of Justice Obomanu of the Rivers State High Court, who on December 20, 2024, declared the APC congresses conducted in the state invalid.
Following the High Court ruling, Tony Okocha and other affected party officials had approached the Court of Appeal through Suit No. CA/PH/523/2024, seeking to overturn the judgment.
However, the Court of Appeal dismissed the challenge and upheld the decision of the lower court, effectively sustaining the nullification of the congresses that produced the Okocha-led executive committee.
The ruling is expected to have significant implications for the leadership structure of the APC in Rivers State, as it reinforces the position that the congresses which brought the executives into office were not validly conducted.
