ABUJA — The Federal High Court in Abuja has dismissed a lawsuit filed by Multichoice Nigeria challenging the Federal Competition and Consumer Protection Commission (FCCPC)’s move to block a planned price increase by the company.
In a ruling delivered on Thursday, Justice James Omotosho described the case as an abuse of court process, noting that it was filed despite a similar, ongoing suit on the same matter.
The judge pointed out that a prior case brought by a consumer rights advocate, Festus Onifade, which also involves both Multichoice and the FCCPC, is still pending before the same court. Justice Omotosho held that filing a separate suit while the earlier one is unresolved undermines judicial proceedings.
