PORT HARCOURT — The Federal High Court in Port Harcourt has fixed May 21, 2025, to begin hearing a lawsuit challenging the legality of President Bola Tinubu’s declaration of a state of emergency in Rivers State.
The suit, filed by Belema Briggs and others, names President Tinubu, the National Assembly, Attorney General of the Federation Lateef Fagbemi, Sole Administrator of Rivers State retired Vice Admiral Ibok-Ete Ibas, and the Nigerian Navy as defendants.
The plaintiffs are contesting the March 18 declaration, which led to the suspension of the Governor, Deputy Governor, and members of the State House of Assembly. They are asking the court to determine whether the President has the constitutional authority to suspend duly elected officials, whose tenures are guaranteed for four years under the Nigerian Constitution.
